Terms of service

These Terms of Service (“Terms”) govern your access to and use of airys (the “Services”), operated by airys, inc. (“airys,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to these Terms.

Please read these Terms carefully. They form a binding agreement between you (and, if you use the Services on behalf of an organization, that organization) and airys, inc. If you do not agree to these Terms, do not use the Services.

1. Agreement to terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy policy, and, where you process the personal data of others through the Services, our Data Processing Addendum. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and that the registration information you provide is accurate and complete.

3. Accounts and sign-in

In short: You are responsible for your account and your team's activity on it.

Accounts are created and authenticated through our login partner, Auth0 by Okta, using a Google account. You are responsible for maintaining the security of the credentials used to access your account and for all activity that occurs under it. Notify us promptly at legal@airys.ai if you suspect any unauthorized use.

You are responsible for the actions of every team member, agent, or end user you invite to or expose to your project.

4. The Services and beta status

In short: airys is in private beta and is provided on an evolving basis.

The Services are currently offered in private beta. Features may change, be added, or be removed, and the Services may be unavailable from time to time. During the beta period we do not commit to any specific uptime, service level, or support response time unless separately agreed in writing. We may impose or adjust usage limits, plan features, and pricing as the product develops.

5. Plans, billing, and payments

In short: Plans are flat monthly (or annual) prices billed through Stripe. We don't offer refunds, but you can cancel anytime.

We offer Free, Pro, and Business plans at flat prices that are not charged per seat. Paid plans are billed in advance on a monthly or annual basis. Annual plans are billed for ten months' price in exchange for twelve months of service. Your plan's capacity is measured by conversation volume — a conversation is one end-to-end widget or email session — and by the other limits described on our pricing page.

Payments are processed by our payment provider, Stripe. By providing payment details, you authorize us and Stripe to charge the applicable fees, including any taxes, to your payment method. We do not store full card details ourselves.

You may cancel at any time from your billing settings; access continues until the end of the current billing period. Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial periods, unused capacity, or plan downgrades. If you exceed your plan's conversation limit, the widget may stop accepting new conversations until the next billing cycle or until you upgrade.

6. Acceptable use

You agree not to, and not to permit others to:

  • use the Services in violation of any applicable law or regulation;
  • upload or transmit unlawful, infringing, harmful, or malicious content;
  • attempt to gain unauthorized access to the Services, other accounts, or our systems;
  • interfere with or disrupt the integrity or performance of the Services;
  • reverse engineer, scrape, or resell the Services except as permitted by law;
  • use the Services to send spam or to harass, abuse, or harm another person; or
  • use the Services to build a competing product or to train a competing model.

We may suspend or limit access that we reasonably believe violates this section or poses a risk to the Services or other users.

7. Your content and data

In short: You own your content. You grant us a limited license to operate the Services.

As between you and airys, you retain all rights to the help-center articles, configuration, conversations, tickets, and other content you create or submit (“Customer Content”). You grant us a worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide, secure, and improve the Services for you.

Where Customer Content includes personal data of your end users, you act as the controller and airys acts as the processor; that processing is governed by our Data Processing Addendum and Privacy policy. You are responsible for having the necessary rights and notices to submit Customer Content and to have us process it.

8. AI features and disclaimer

In short: AI answers are grounded in your content but can still be wrong — review before relying on them.

The Services use AI, including Amazon Bedrock, to generate answers grounded in your indexed help-center content and to assist your team. AI-generated output may be inaccurate, incomplete, or out of date, and does not constitute professional, legal, financial, or other advice. You are responsible for reviewing AI output before relying on it or surfacing it to your customers. The Services are designed to cite sources and to escalate to your team when grounding is unavailable, but we do not warrant that every output is accurate.

9. Intellectual property

The Services, including the software, design, trademarks, and all related intellectual property, are owned by airys, inc. and its licensors. Except for the rights expressly granted to you in these Terms, we reserve all rights, title, and interest in and to the Services. We may use aggregated, de-identified data that does not identify you or any individual to operate and improve the Services.

10. Third-party services

The Services rely on third-party providers, including Amazon Web Services and Amazon Bedrock (hosting and AI), MongoDB Atlas (data storage), Auth0 by Okta (authentication), and Stripe (payments). Your use of those features may be subject to the respective providers' terms. We are not responsible for the acts or omissions of third-party providers.

11. Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Because the Services are offered in beta, you acknowledge they may contain defects and may not operate without interruption or error.

12. Limitation of liability

To the maximum extent permitted by law, airys, inc. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability arising out of or related to these Terms will not exceed the greater of (a) the amounts you paid to us for the Services in the twelve months before the event giving rise to the liability, or (b) one hundred US dollars (US$100).

13. Indemnification

You agree to indemnify and hold harmless airys, inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Services, or your violation of these Terms or applicable law.

14. Suspension and termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your use poses a security or legal risk. On termination, your right to use the Services ceases; you may export or request deletion of your project's data as described in our Privacy policy. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable US federal law, without regard to conflict-of-laws principles. You agree that the courts located in Puerto Rico will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to personal jurisdiction there.
